Welcome to Phone Banking for Good. These Terms of Use ("Terms") govern your access to and use of our phone banking platform and services (collectively, the "Service"). By registering for, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Notice.

Please read these Terms carefully. If you do not agree to these Terms, you may not use the Service.

1. Definitions

"Organisation" means any political campaign, advocacy group, trade union, membership organisation, or non-profit entity that subscribes to the Service.

"Administrator" means an individual authorised by an Organisation to manage the Service on behalf of that Organisation.

"Volunteer" means an individual authorised by an Organisation to use the Service for phone banking activities.

"User" means any Administrator or Volunteer using the Service.

2. Acceptance of Terms

By creating an account, accessing the Service, or using any feature of the platform, you:

  • Confirm that you are at least 18 years of age;
  • Agree to comply with these Terms and all applicable laws and regulations;
  • Acknowledge that you have read and understood our Privacy Notice; and
  • Agree to receive transactional emails and service notifications necessary for the operation of your account.

3. Service Description

Phone Banking for Good provides a cloud-based platform that enables Organisations to:

  • Manage phone banking campaigns;
  • Coordinate volunteers for political, advocacy, and community engagement activities;
  • Track calling outcomes and campaign progress;
  • Integrate with Action Network for contact management; and
  • Generate reports and analytics.

Volunteers use their own personal devices to make calls through the platform. We do not provide telecommunications services or calling minutes.

4. Account Registration and Security

4.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorised use of your account or any other breach of security at support@djns.tech.

4.2 Account Accuracy

You agree to provide and maintain accurate, current, and complete information in your account. Providing false or misleading information may result in immediate termination of your account.

4.3 One Account Per Person

Each User may maintain only one account. Creating multiple accounts may result in suspension or termination of all associated accounts.

5. Subscription and Payment

5.1 Subscription Model

The Service operates on a paid subscription basis. Subscription plans, pricing, and features are detailed on our website and may be updated from time to time with reasonable notice.

5.2 Payment Terms

Organisations subscribing to the Service agree to:

  • Pay all subscription fees when due;
  • Provide valid payment information; and
  • Authorise us to charge the provided payment method on a recurring basis until the subscription is cancelled.

5.3 Cancellation and Refunds

Organisations may cancel their subscription at any time through the account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial billing periods except as required by law.

Upon cancellation, your Organisation will retain read-only access to historical data for 30 days, after which data may be deleted in accordance with our Privacy Notice.

6. Acceptable Use

6.1 Permitted Use

You may use the Service only for lawful purposes relating to political campaigns, advocacy, community engagement, and membership communications. All use must comply with:

  • UK data protection laws (GDPR and Data Protection Act 2018);
  • Privacy and Electronic Communications Regulations (PECR);
  • Ofcom regulations and guidelines;
  • Electoral Commission rules (where applicable); and
  • All other applicable laws and regulations.

6.2 Prohibited Activities

You agree not to:

  • Use the Service for any unlawful purpose or to violate any laws;
  • Make unsolicited marketing calls or spam calls;
  • Contact individuals who have opted out or registered with the Telephone Preference Service (TPS) unless you have a legitimate basis under PECR;
  • Engage in harassment, intimidation, or abusive behaviour toward call recipients;
  • Misrepresent your identity, Organisation, or purpose when making calls;
  • Attempt to gain unauthorised access to the Service, other accounts, or computer systems;
  • Interfere with or disrupt the Service or servers or networks connected to the Service;
  • Use any automated system, including robots, spiders, or scrapers, to access the Service;
  • Reverse engineer, decompile, or disassemble any portion of the Service;
  • Remove, obscure, or alter any proprietary rights notices on the Service; or
  • Use the Service to store or transmit malicious code, viruses, or harmful software.

6.3 Compliance with Calling Regulations

When making calls through the Service, you must:

  • Respect call recipients' privacy and preferences;
  • Honour do-not-call requests immediately and permanently;
  • Clearly identify yourself and your Organisation;
  • Call only during reasonable hours (typically 9am-9pm local time);
  • Maintain accurate records of consent where required; and
  • Comply with any additional requirements under political campaign regulations.

7. Use of Personal Devices

Volunteers use their own personal mobile phones or devices to make calls through the Service. By using your personal device:

  • You acknowledge that your phone number may be visible to call recipients unless you take steps to withhold it;
  • You are responsible for any charges from your mobile carrier for calls, data, or other services;
  • You agree to maintain reasonable security measures on your device, including using a passcode or biometric lock;
  • You are responsible for any loss or unauthorised access to contact data stored temporarily on your device; and
  • You agree to report any lost or stolen devices to your Administrator immediately.

8. Data Protection Responsibilities

8.1 Your Organisation's Responsibilities

Your Organisation is the data controller for contact data processed through the Service. Your Organisation is responsible for:

  • Ensuring it has a lawful basis for processing contact data;
  • Providing appropriate privacy notices to call recipients;
  • Responding to data subject rights requests;
  • Maintaining appropriate data retention policies; and
  • Training volunteers on data protection requirements.

8.2 Volunteer Responsibilities

As a Volunteer, you agree to:

  • Handle all personal data in accordance with your Organisation's instructions and data protection laws;
  • Keep contact information confidential and use it only for authorised phone banking activities;
  • Not share, copy, or export contact data except as authorised by your Organisation;
  • Report any suspected data breaches to your Administrator immediately; and
  • Delete or return all contact data upon termination of your volunteering role or as instructed.

8.3 Our Role as Data Processor

Phone Banking for Good acts as a data processor for contact data processed through the Service. We process data only in accordance with your Organisation's instructions and maintain appropriate technical and organisational security measures as detailed in our Privacy Notice.

9. Intellectual Property Rights

9.1 Our Intellectual Property

The Service, including all software, technology, designs, logos, trademarks, and content (excluding User Content), is owned by Phone Banking for Good or its licensors and is protected by copyright, trademark, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the Service or our intellectual property, except for the limited right to use the Service in accordance with these Terms.

9.2 Your Content

You retain all rights to any content, data, or information you upload to or create through the Service ("User Content"), including contact data, call notes, and campaign materials.

You grant us a limited, non-exclusive, royalty-free licence to use, store, and process User Content solely to provide and improve the Service. This licence terminates when you delete your content or close your account, except for data we are required to retain for legal or regulatory purposes.

9.3 Feedback

If you provide us with any feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, modify, and incorporate such feedback into the Service without any obligation to you.

10. Third-Party Services and Integrations

The Service integrates with third-party platforms, including Action Network. Use of these third-party services is subject to their respective terms of service and privacy policies.

We are not responsible for:

  • The availability, accuracy, or content of third-party services;
  • Any loss or damage arising from your use of third-party services; or
  • Third-party handling of your data, which is governed by their own privacy policies.

11. Service Availability and Support

11.1 Service Uptime

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control, including third-party service outages, network disruptions, or force majeure events.

11.2 Modifications to the Service

We reserve the right to modify, update, or discontinue any feature of the Service at any time, with or without notice. We will provide reasonable advance notice of material changes that negatively impact your use of the Service.

11.3 Support

Support is provided via email at support@djns.tech. We aim to respond to support requests within 2 business days but do not guarantee specific response times.

12. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your specific requirements;
  • The Service will be uninterrupted, timely, secure, or error-free;
  • Any errors in the Service will be corrected; or
  • The Service is free from viruses or other harmful components.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHONE BANKING FOR GOOD SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL;
  • SERVICE INTERRUPTIONS OR DOWNTIME;
  • UNAUTHORISED ACCESS TO YOUR DATA OR SYSTEMS;
  • ERRORS OR OMISSIONS IN CONTENT OR DATA;
  • THIRD-PARTY CONDUCT OR CONTENT; OR
  • ANY OTHER MATTER RELATING TO THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under UK law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Phone Banking for Good, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or regulation; (d) your violation of any third-party rights; or (e) any content or data you submit to or through the Service.

15. Termination

15.1 Termination by You

You may terminate your account at any time by contacting your Organisation's Administrator or, for Administrators, through the account settings. Upon termination, your subscription will continue until the end of the current billing period.

15.2 Termination by Us

We may suspend or terminate your access to the Service immediately, with or without notice, if:

  • You breach these Terms;
  • Your Organisation's subscription payment fails or is overdue;
  • You engage in fraudulent, abusive, or illegal activity;
  • Your use of the Service poses a security risk or potential harm to others; or
  • We are required to do so by law or legal process.

15.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases;
  • You must cease all use of the Service and delete any downloaded materials;
  • We may delete your account and User Content in accordance with our Privacy Notice and data retention policies;
  • Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply; and
  • You remain liable for any outstanding fees or obligations incurred before termination.

16. Dispute Resolution and Governing Law

16.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

16.2 Jurisdiction

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.

16.3 Informal Resolution

Before initiating formal legal proceedings, we encourage you to contact us at support@djns.tech to attempt to resolve any disputes informally. We are committed to working in good faith to address your concerns.

17. General Provisions

17.1 Changes to Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or service features. Material changes will be communicated via:

  • Email notification to registered users;
  • Prominent notice on the platform; or
  • Updated "Last Updated" date at the top of this document.

Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

17.2 Entire Agreement

These Terms, together with our Privacy Notice and any additional agreements you enter into with us, constitute the entire agreement between you and Phone Banking for Good regarding the Service and supersede all prior agreements and understandings.

17.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17.4 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future. Any waiver must be in writing and signed by an authorised representative of Phone Banking for Good.

17.5 Assignment

You may not assign or transfer these Terms or your rights and obligations under them without our prior written consent. We may assign or transfer these Terms without restriction.

17.6 No Partnership

Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between you and Phone Banking for Good. You have no authority to bind us or make commitments on our behalf.

17.7 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labour, or materials.
